RE: The tariff classification of yarns from Taiwan

Dear Mr. Wang:

In your letter dated April 12, 2000, you requested a classification ruling.

Three samples of yarn were submitted. Style FM88045LA is a plied yarn consisting of a rayon staple fiber ply, a textured nylon filament ply and a spandex ply. The overall fiber composition of the yarn is 60 percent staple rayon, 36 percent nylon filament and 2 percent spandex. Yarn 2070A is a multifilament plied yarn made of 92 percent textured nylon and 8 percent spandex. The decitex per single yarn is given as 77. Style FM88146 is a multiple ply yarn consisting of 80 percent viscose rayon filament, 19 percent textured nylon filament and 1 percent spandex. None of the above yarns are put up for retail sale. They are intended to be used for industrial knitting.

The applicable subheading for FM88045LA will be 5510.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for yarn of artificial staple fiber, not put up for retail sale, other yarn, other. The duty rate will be 13.9 percent ad valorem.

The applicable subheading for 2070A will be 5402.31.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for synthetic filament yarn, not put up for retail sale, textured yarn, of nylon or other polyamides, measuring per single yarn not more than 500 decitex, multiple (folded) or cabled yarn. The duty rate will be 8.4 percent ad valorem.

The applicable subheading for FM88146 will be 5403.41.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for artificial filament yarn, not put up for retail sale, other yarn, multiple, of viscose rayon. The duty rate will be 9.1 percent ad valorem.

FM88045LA falls within textile category designation 607. 2070A falls within textile category designation 600. FM88146 falls within textile category designation 606. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
